Terms and Conditions of Usage clauses define the conditions which one must accept in order to use the Archodia and Archodia Music websites and products/services (Archodia Radio, RNB Hits Radio).

It is adviceable for users to read these terms before the use of the Archodia Music websites, its services and submitting content in the form of airplay, streaming, promotion, or otherwise any other form of distribution. Once you are using Archodia and its music products/services, you automatically agree to the policies laid out therein. If you do not agree with these terms and policies, please do not use this website, its services nor submit any content for airplay, streaming, or any other form of distribution.

Archodia is committed to protecting your privacy and providing audio and video content that will give you the best online entertainment and safe browsing.

USE OF COOKIES
Cookies are small files or other pieces of data that are downloaded or stored on your computer or other devices, that can be tied to information about your use of our website. We use these files to provide some services and features offered on our websites to improve our user experience. Using Archodia services you agree and accept such use of cookies unless you later decide to disable them.

Note that if you delete or disable our cookies you may experience interruptions or limited functionality in certain areas of our websites, brands and services.

DATA COLLECTION

Archodia collects personally identifiable information such as your email address, name, and country. This information is used to provide you with the best possible services available in terms of quality and operation and provides general statistics regarding the use of Archodia and services.

Keep in mind that if you directly disclose your personal information or sensitive data through the Archodia interaction services or other public boards related or not related to Archodia, this information may be used by others and Archodia will not be held liable.

Archodia is not responsible for the privacy statements or contents on websites that are outside of our website or services.

USE OF YOUR DATA
Archodia collects and uses your personal and data information to;

- deliver the services you have requested.

- inform you of other latest products or services.

- deliver you with the latest entertainment news and alerts in the form of newsletters.

- contact you via surveys to conduct research about your opinion of current services or of new services that may be offered in the future by Archodia or it's affiliated, partners.

- contact you in the case of contest and giveaway wins.

- inform you from time to time or contact you on behalf of its affiliates and business partners about a particular product or service that may be of interest to you. In these cases, your unique personal information which includes e-mail addresses, names, addresses, and telephone numbers are not shared nor transferred to the third party.

- share data with trusted partners and affiliates to help us perform statistical analysis, send you email or postal mail, provide customer support, arrange for deliveries when you win a contest or giveaway prize, or make payments to you. In these cases, such third parties are prohibited from using your personal information for purposes outside of providing these services and are required to maintain the confidentiality of this information.

- keep track of our Web sites, mobile apps, and services used in other to determine what and which of our services are most popular. This data is only used to provide users with customized content and advertise with the Archodia atmosphere.

Archodia will not disclose or release the information you have left with us to third parties for reasons outside the ones given above.

Archodia will disclose your personal information, without your notice if only required by law to do so or if with belief that such action is necessary to (a) conform to the edicts of the law or comply with legal process served on Archodia; (b) protect and defend the rights or property of Archodia; (c) act under exigent circumstances to protect the personal safety of users or Archodia and the public in general.

CONTENT SUBMISSION
Archodia is accepting music (audio and video) and written content from artists and podcasters/radio station owners for airplay, exposure, streaming, and promotion. These audio files and contents are used for the sole purpose of entertaining the general public or for any other legal purpose stated by the artist, downloadable, and sales.

Archodia does not claim ownership of the content. By submitting content to Archodia for inclusion on its streaming platform and radio stations (Archodia Music  & RNB Hits Radio) for promotion,

a.) you grant Archodia, the worldwide, royalty-free, and non-exclusive license to reproduce, modify, adapt and publish the Content solely for the purpose of displaying and promoting our Internet properties, or any related company thereof,

b.) you acknowledge that Archodia does not pre-screen Content, but that Archodia and its designees shall have the right (but not the obligation) in their sole discretion to refuse or remove any Content that is available via the Service. Without limiting the foregoing, Archodia and its designees shall have the right to remove any Content that violates the Terms Of Service or is otherwise objectionable,

c.) you agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content.

d.) you acknowledge that Archodia Radio, and RNB Hits Radio are the products of Archodia Music, a service of Archodia.com, Limited also known as Archodia. All radio station names, logos, brands and other trademark features in the Archodia Radio app are the property of their respective trademark holders. All radio stations included within Archodia Radio have provided us with written permission to use their respective names, streaming URLs, logos and trademark features.​

• As of Jan. 1, 2020, our radio station (RNB Hits Radio) became a loyalty-free station. By submitting your music, you agree, grant permission to RNB Hits Radio to broadcast only the songs being submitted in this form royalty-free without recourse. This does not affect your music on Archodia Music.

• Your music submissions played on these radio stations (RNB Hits Radio and Archodia Radio) are for promotional activities and SPOTLIGHT plays to create a buzz around your music and boost sales. Music Submissions are Subject to approval but due to volume, it can take up to two weeks to be reviewed so please be patient and do not resubmit.

• Not all music submitted is of good quality or right for our broadcast therefore it may not be allowed to air. This does not affect the addition of your press release content on our blog.

• Archodia Music in partnership with YouTube uses the YouTube API to make your songs available for streaming on Archodia Music. If you have submitted your songs to YouTube, they will be available on Archodia Music.

Archodia will not accept any content to be played, streamed, or aired on her platform and radio stations (RNB Hits Radio and Archodia Radio), or partner channels (Online Radios) if the content or its content (Online Radios) is not legal. If your work is streaming or playing on Archodia Music, Archodia Radio or RNB Hits Radio illegally without the proper rights contact us via music@archodia.com and we will address the issue ASAP.

Airplay on Archodia Radio and RNB Hits Radio is for artists that own the rights to their music, podcasters, and radio station owners with proper licensing or labels representing these rights. Do not upload contents if you do not own the rights.

If any of your work is playing or has been used on these channels without the proper legal rights, please submit a DMCA NOTICE via music@archodia.com with the;

content name and information and link to your work on Archodia Music, Archodia Radio, RnB Hits Radio,

Identify yourself as either: a) The owner of a copyrighted work(s), or A person "authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."

b) Identify the copyrighted work claimed to have been infringed

c) Identify the material that is claimed to be infringing or to be the subject of the infringing activity and that is to be removed or access to which is to be disabled as well as information reasonably sufficient to permit Archodia to locate the material.

d) Provide contact information that is sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, a valid electronic mail address.

e) State that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agents, or the law.

f) State that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed and we will take the necessary action to take it down ASAP.​

DESCRIPTION OF SERVICE
Archodia provides users with access to its website, radio station, and radio information services (the “Service”). Unless explicitly stated otherwise, any new features that augment or enhance the current Service, including the release of new Archodia Music resources, shall be subject to the Terms Of Service. In order to use the Service, you must obtain access to the Internet, either directly or through devices that provide access and pay any service fees associated with such access. In addition, you must provide all equipment necessary to make such a connection to the Internet, including but not limited to a computer and modem or other access devices. Please note that Archodia may create certain areas on the Service that contain a subscription service. You must keep your account’s balance up to date in order to view these areas (subscription service, if applicable, is covered elsewhere). Archodia shall not provide the Service to persons under the age of 13 without explicit parental consent.​

REGISTRATION OBLIGATIONS
In consideration of use of the Service, you agree to (a) provide true, accurate, current, and complete information about yourself as prompted by the Service’s registration form (such information being the “Registration Data”) and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, ILLEGAL or Archodia / has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete or ILLEGAL, Archodia has the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof), as well as declare Breach of Contract and refuse to grant access to the Service.​

MEMBER CONDUCT
You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages or other materials (“Content”), whether publicly posted or privately transmitted, are the sole responsibility of the person from which such Content originated. This means that you, and NOT Archodia, are entirely responsible for all Content that you upload, post, or otherwise transmit via the Service. Archodia does not control the content posted via the Service and, as such, does not guarantee the accuracy, integrity, or quality of such Content. You understand that by using the Service, you may be exposed to Content that is offensive, indecent, objectionable, malicious, or further damaging.

You agree not to use the Service to:

(a) upload, post or otherwise transmit any Content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable;

(b) harm minors in any way;

(c) impersonate any person or entity, including, but not limited to, Archodia.com, Limited and affiliates, forum/website administrator, guide or host, or falsely state or otherwise misrepresent your affiliation with a person or entity;

(d) forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Service or develop restricted or password-only access pages, or hidden pages or images (those not linked to from another accessible page) in an attempt to defraud Archodia;

(e) upload, post or otherwise transmit any Content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);

(f) upload, post, or otherwise transmit any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party;
(g) upload, post, or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation, except in those areas of the Service that are designated for such purpose;
(h) upload, post, or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
(i) disrupt the normal flow of dialogue, cause a screen to “scroll” faster than other users of the Service are able to type, or otherwise act in a manner that negatively affects other users’ ability to engage in real-time exchanges;
(j) interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service;

(n) promote or provide instructional information about illegal activities, promote physical harm or injury against any group or individual, or promote any act of cruelty to animals. This may include, but is not limited to, providing instructions on how to assemble bombs, grenades, and other weapons, and creating “Crush” sites, or interfere or otherwise interrupt the broadcast of FCC-licensed stations;
(o) use your page (or directory) as storage for remote loading or as a door or signpost to another home page, whether inside or beyond Archodia;
(p) have multiple Archodia user accounts or
(q) engage in commercial activities without enrolling in Archodia approved affiliate programs. This includes, but is not limited to, the following activities:
• offering for sale any products or services;
• soliciting for advertisers or sponsors;
• conducting raffles or contests that require any type of entry fee;
• displaying a sponsorship banner of any kind, including those that are generated by banner or link exchange services, with the sole exceptions of banners provided by or prior approved by Archodia;
• displaying banners for services that provide cash or cash-equivalent prizes to users in exchange for hyperlinks to their web sites.
(r) You agree and acknowledge that Archodia has not reviewed any contents as to their acceptability, legality, or for any other purpose. You further agree that it is not Archodia‘s responsibility to do any such review for appropriateness but merely to host the Site on your behalf.​

SPECIAL ADMONITIONS FOR INTERNATIONAL USE
Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable Content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside.​

INDEMNITY
You agree to indemnify and hold Archodia, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your Content, your use of the Service, your connection to the Service, your violation of the Terms Of Service, or your violation of any rights of another.​

NO RESALE OF SERVICE
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service.​

MODIFICATIONS TO SERVICE
Archodia reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that Archodia shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.​

TERMINATION
You agree that Archodia, in its sole discretion, may terminate your account, Site, use of the Service or use of any other Archodia service, and remove and discard any Content within the Service, for any reason, including, without limitation, for lack of use or if we (Archodia and it's affiliated, partners) believes that you have violated or acted inconsistently with the letter or spirit of this Terms Of Service. Archodia may also in its sole discretion and at any time discontinue providing the Service, or any part thereof, with or without notice. You agree that any termination of your access to the Service under any provision of this Terms may be effected without prior notice, and acknowledge and agree that Archodia may immediately deactivate or delete your account and all related information and files linked to your account and/or bar any further access to such files or the Service. You agree that Archodia shall not be liable to you or any third-party for any termination of your access to the Service. Further, upon the termination of the Service, you agree to forfeit any and all payments and give Archodia the right to cancel in-transit payments.​

PROPRIETARY RIGHTS
You acknowledge and agree that the Service and any necessary software used in connection with the Service (“Software”) contain proprietary and confidential information that is protected by applicable intellectual property and other laws. You further acknowledge and agree that Content contained in sponsor advertisements or information presented to you through the Service or advertisers is protected by copyrights, trademarks, service marks, patents, or other proprietary rights and laws. Except as expressly authorized by Archodia or advertisers, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Service or the Software, in whole or in part. Archodia grants you a personal, non-transferable, and non-exclusive right and license to use the object code of its Software on a single computer; provided that you do not (and do not allow any third party to) copy, modify, create a derivative work of, reverse engineer, reverse assemble or otherwise attempt to discover any source code, sell, assign, sublicense, grant a security interest in or otherwise transfer any right in the Software. You agree not to modify the Software in any manner or form, or to use modified versions of the Software, including (without limitation) for the purpose of obtaining unauthorized access to the Service. You agree not to access the Service by any means other than through the services explicitly designated for use in accessing the Service.​

Archodia uses third-party advertising companies to serve ads or promotions when you use our services or visit our websites. These companies may use cookies or information, not including your name, address, email, or telephone number about your visits to the Archodia website or any of our products/services in order to provide you with advertisements about goods and services that may be of interest to you.

By utilizing this website and services, you agree that Archodia has the right to run such advertisements and promotions. The manner, mode, and extent of advertising are subject to change. Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the Service, including payment and delivery of related goods or services, and any other terms, conditions, warranties, or representations associated with such dealings, are solely between you and such advertiser. No warranty of any kind, either expressed or implied, is made as to the accuracy, reliability, or correctness of this information and bio. Some artist bios may not be accurately populated due to the limitations of the automated information provider software.​

We advise that users of the Archodia Music website and Web Player should check that their information is accurate and if not, notify Archodia for corrections or Claim their Artist Profile to manage/correct this information themselves.​
