Terms and Conditions of Usage clauses define the conditions one must accept when using Archodia.com and its subdomains, products, and services.

Archdoia AB (“Archodia”), located at Lantmanavagen 20, 46160 Trollhättan, Sweden, provides users (“Users”) of the web pages located at archodia.com (the “Site”), and all its associated brands, products, and subdomains, with services (the “Services”). These Services may include, but are not limited to, cataloging, indexing, sharing, and streaming user content.

Please read them (these “Terms”) carefully as they govern your use of (which includes access to) Archodia’s services, including all of its websites, brands, and software applications that incorporate or link to these Terms (known as the “Service” and collectively, the “Archodia Services”).

The User Policy defines the User behaviour when using the Archodia Services, including but not limited to how they submit content and comments.

Description of Service
Archodia provides users with access to its website and Archodia Services. Unless explicitly stated otherwise, any new features that augment or enhance the current Archodia Services shall be subject to the Terms of Service. To use the Archodia Services, you must obtain access to the Internet, either directly or through devices that provide access, and pay any service fees associated with such access. In addition, you must provide all equipment necessary to make such a connection to the Internet, including but not limited to a computer and modem or other access devices. Please note that Archodia may create certain areas on the Archodia Services that contain a subscription service. You must keep your account’s balance up to date to view these areas (subscription service, if applicable, is covered elsewhere).

Registration Obligations
In consideration of the use of the Archodia Services, you agree to (a) provide true, accurate, current, and complete information about yourself as prompted by the Archodia Service’s registration form (such information being the “Registration Data”) and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. (q) engage in commercial activities without enrolling in Archodia-approved affiliate programs. This includes, but is not limited to, the following activities:

  • offering for sale any products or services;
  • soliciting for advertisers or sponsors;
  • conducting raffles or contests that require any type of entry fee;
  • displaying a sponsorship banner of any kind, including those that are generated by banner or link exchange services, with the sole exceptions of banners provided by or prior approved by Archodia;
  • displaying banners for services that provide cash or cash-equivalent prizes to users in exchange for hyperlinks to their websites.

You agree and acknowledge that Archodia has not reviewed any contents as to their acceptability, legality, or for any other purpose. You further agree that it is not Archodia‘s responsibility to do any such review for appropriateness but merely to host the the content on your behalf.

Content Submission
Archodia accepts content submission (music, audio, video, and written content) from artists, podcasters/radio station owners, and PR agencies for airplay, exposure, streaming, and promotion. These contents are used for the sole purpose of entertaining the general public or for any other purpose stated by the artist, downloadable, and for sale.

Archodia does not claim ownership of the content. By submitting content to Archodia for promotion via any of our Services,

a.) you grant Archodia, the worldwide, royalty-free, and non-exclusive license to reproduce, modify, adapt and publish the content solely for the purpose of displaying and promoting on our Internet properties, or any related company thereof,

b.) you acknowledge that Archodia does not pre-screen content, but that Archodia and its designees shall have the right (but not the obligation) in their sole discretion to refuse or remove any content that is available via the Archodia Service. Without limiting the foregoing, Archodia and its designees shall have the right to remove any content that violates the Terms of Service or is otherwise objectionable,

c.) you agree that you must evaluate, and bear all risks associated with, the use of any content, including any reliance on the accuracy, completeness, or usefulness of such content.

d.) you acknowledge that Archodia Music is a service of Archodia. All radio station names, logos, brands, and other trademark features in the Archodia Music app are the property of their respective trademark holders. All radio stations included within Archodia Music have provided us with written permission to use their respective names, streaming URLs, logos and trademark features where applicable.

As of Jan. 1, 2020, RNB Hits Radio became a loyalty-free station. By submitting your music, you agree and grant permission to RNB Hits Radio to broadcast only the songs being submitted in this form, royalty-free, without recourse. This does not affect your music on Archodia Music, which is being populated via our partner services. See our Privacy Policy for more details.

As of July 22, 2024, RNB Hits Radio has fully integrated its playlist with Archodia Music. This means that audio content is henceforth streamed on RNB Hits Radio from Archodia Music, which is affiliated with or connected to music distribution partners via partner-certified official APIs. See our Privacy Policy for more details.

e.) you acknowledge that your content submission is for promotional activities to create a buzz and boost sales. Content submissions are subject to approval, but due to volume, it can take up to two weeks to be reviewed so please be patient and do not resubmit.

Archodia uses partner-certified official APIs to make your songs and image covers available for streaming on Archodia Music. If you have submitted your songs to YouTube, they will be available on Archodia Music. To have your songs removed from Archodia Music, you will need to contact your distribution company to have them removed from our partners’ directory before informing Archodia of removal.

Music upload on Archodia Music is for artists who own the rights to their music, podcasters, and radio station owners with proper licensing or labels representing these rights. Do not upload content if you do not own the rights.

Archodia will not accept any content to be played, streamed, or aired on its platform, or partner channels (Online Radios) if the content or its content (Online Radios) is not legal. If your work is streaming or playing on Archodia Music illegally without the proper rights, please contact us via music@archodia.com, and we will address the issue ASAP.

If you believe any of your work is playing or has been used on Archodia without the proper legal rights, please submit a DMCA NOTICE via music@archodia.com with the content name and information, and link to your work on Archodia;

Identify yourself as either:

  • a) The owner of a copyrighted work(s), or A person “authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.”
  • b) Identify the copyrighted work claimed to have been infringed.
  • c) Identify the material that is claimed to be infringing or to be the subject of the infringing activity and that is to be removed or access to which is to be disabled as well as information reasonably sufficient to permit Archodia to locate the material.
  • d) Provide contact information that is sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, a valid electronic mail address.
  • e) State that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agents, or the law.
  • f) State that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed, and we will take the necessary action to take it down ASAP.

Special Admonitions for International Use
Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable Content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from the country in which you reside.

Indemnity
You agree to indemnify and hold Archodia, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your Content, your use of the Service, your connection to the Service, your violation of the Terms Of Service, or your violation of any rights of another.

No Resale of Service
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service.

Notification of Service
Archodia reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Archodia Service (or any part thereof) with or without notice. You agree that Archodia shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.

Termination
You agree that Archodia, in its sole discretion, may terminate your account, Site, use of the Archodia Service, and remove and discard any Content within the Service, for any reason, including, without limitation, for lack of use or if we (Archodia and it’s affiliated, partners) believes that you have violated or acted inconsistently with the letter or spirit of this Terms Of Service. Archodia may also in its sole discretion and at any time discontinue providing the Service, or any part thereof, with or without notice. You agree that any termination of your access to the Service under any provision of these Terms may be effected without prior notice, and acknowledge and agree that Archodia may immediately deactivate or delete your account and all related information and files linked to your account and/or bar any further access to such files or the Service. You agree that Archodia shall not be liable to you or any third party for any termination of your access to the Service. Further, upon the termination of the Service, you agree to forfeit any and all payments and give Archodia the right to cancel in-transit payments.

Prioprietary Rights
You acknowledge and agree that the Service and any necessary software used in connection with the Service (“Software”) contain proprietary and confidential information that is protected by applicable intellectual property and other laws. You further acknowledge and agree that Content contained in sponsor advertisements or information presented to you through the Service or advertisers is protected by copyrights, trademarks, service marks, patents, or other proprietary rights and laws. Except as expressly authorized by Archodia or advertisers, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Service or the Software, in whole or in part. Archodia grants you a personal, non-transferable, and non-exclusive right and license to use the object code of its Software on a single computer; provided that you do not (and do not allow any third party to) copy, modify, create a derivative work of, reverse engineer, reverse assemble or otherwise attempt to discover any source code, sell, assign, sublicense, grant a security interest in or otherwise transfer any right in the Software. You agree not to modify the Software in any manner or form, or to use modified versions of the Software, including (without limitation) for the purpose of obtaining unauthorized access to the Service.
